In May 2024, the CFTC published a report titled "Responsible Artificial Intelligence in Financial Markets: Opportunities, Risks & Recommendations," signaling its intent to oversee the AI space. The report highlighted the potential for AI to undermine public trust in financial markets due to its opaque decision-making processes. The CFTC emphasized the need for federal collaboration and public discourse to develop transparent and effective AI policies.


Impact on Existing Regulatory Frameworks

The SEC, for example, has been working on rules addressing potential conflicts of interest arising from the use of predictive data analytics (PDA) in investor interactions. These proposals, first introduced in July 2023, call for the documentation and swift resolution of any conflicts of interest. During a panel discussion in June 2024, the SEC's Investor Advisory Committee largely supported these proposals, suggesting that they could be enacted soon.


FINRA has also taken steps to clarify its position on AI-generated content. The organization updated its FAQs in May 2024, reiterating that firms are responsible for supervising AI-driven communications. Companies must establish clear policies and procedures to oversee AI use, addressing how technologies are chosen, how staff are trained, and the extent of human oversight in content generation.


The CFTC, meanwhile, continues to advocate for public discussions and cross-agency collaboration to address the challenges posed by AI. The CFTC's report outlined key opportunities, risks, and recommendations for developing a formal AI regulatory framework. The Department of the Treasury has also expressed interest in AI regulation, noting the potential shortage of skilled employees to manage AI tools.
